  1. Introduction Welcome to The Mascot Store, a mascot costume store (the "Store"). These terms of service (the "Terms") govern your access to and use of our services, including the purchase of costumes and related products (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

  2. Use of the Services You may only use the Services for lawful purposes and in accordance with these Terms. You must not use the Services: (a) in any way that breaches any applicable local, national, or international law or regulation; (b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; (c) to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam); (d) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; (e) to damage, disable, overburden, or impair the Store or interfere with any other party's use and enjoyment of the Services.

  3. Product Information and Availability We make every effort to ensure that the information and descriptions of our costumes and related products are accurate and up-to-date. However, we cannot guarantee that the information provided is always error-free or complete.

  4. Order Processing and Delivery All orders are subject to acceptance and availability. If we are unable to fulfill your order, we will notify you as soon as possible.

  5. We do not accept returns of costumes and related products even they are in their original condition. Each mascot is custom made and we are not able to take any items back.

  6. Limitation of Liability In no event shall the Store be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Services, even if the Store or a representative has been notified orally or in writing of the possibility of such damage.

  7. Indemnification You agree to indemnify and hold the Store, its affiliates, and its and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your use of the Services in violation of these Terms and/or your violation of any law or the rights of a third-party.

  8. Changes to the Terms We reserve the right, at our discretion, to modify these Terms at any time. Your continued use of the Services following the posting of changes to these Terms means you accept those changes.

  9. Governing Law These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the USA.
